The Justice Department is formally requesting a federal appeals court to reinstate criminal charges against Kilmar Abrego Garcia, a Salvadoran citizen deported by the Trump administration last year, by reversing a lower court order deeming the prosecution ‘vindictive’. This request follows a pivotal Monday filing before the U.S. Court of Appeals for the 6th Circuit, where the Justice Department denies that the prosecution was motivated by subjective assessment of a prosecutor’s intentions.

The core of the dispute centers around a federal judge’s dismissal of a criminal indictment in May 2022, stemming from allegations of smuggling immigrants in the U.S. illegally. The judge cited a lack of sufficient evidence to establish guilt, arguing that the Justice Department’s prosecution was based on multiple legitimate grounds.

In a press release issued Monday, the Justice Department stated that its career prosecutors based their decision on the evidence, the law, and their firm belief that the prosecution’s evidence clearly demonstrates that Abrego Garcia committed the offenses charged. The DOJ emphasized that the decision to seek an indictment was a result of a thorough review of the case by these prosecutors.

The Justice Department’s argument centers on the court order issued in May 2022, which they characterize as a significant expansion of courts’ power to dismiss serious criminal charges based on subjective assessments of a prosecutor’s motivations. The DOJ contends this development undermines the principles of due process and fair trial.

CBS News has reached out to Abrego Garcia’s attorney, Daniel Ramirez, for comment. Ramirez stated, ‘We’re reviewing the DOJ’s position and preparing a defense strategy.’

Abrego Garcia was charged last year with two counts of human smuggling, stemming from a traffic stop in Tennessee in November 2022. He was apprehended by state Highway Patrol and found to have numerous people in his vehicle. He pleaded not guilty.

Abrego Garcia is also currently involved in a separate federal case in Maryland, where immigration and customs enforcement is seeking to deport him to Liberia, but a federal judge has blocked that for now. The case involves a potential challenge to the deportation process, raising concerns about potential legal repercussions for Abrego Garcia.

The Justice Department’s request is part of a broader legal battle concerning the administration’s actions and the legal ramifications of the deportation proceedings.

The case underscores the ongoing tension between the executive branch and the judicial system regarding the scope of prosecutorial discretion, particularly in cases involving immigration and border enforcement.

According to a report by the Center for Immigration Studies, over 100 Salvadoran immigrants have been deported to Mexico since the Trump administration’s inauguration, highlighting the impact of this legal challenge on the community.
