This request follows a pivotal Monday filing before the U.S. Court of Appeals for the 6th Circuit, where the Justice Department denies that the prosecution was motivated by subjective assessment of a prosecutor’s intentions.

In a press release issued Monday, the Justice Department stated that its career prosecutors based their decision on the evidence, the law, and their firm belief that the prosecution’s evidence clearly demonstrates that Abrego Garcia committed the offenses charged. The DOJ emphasized that the decision to seek an indictment was a result of a thorough review of the case by these prosecutors.
The Justice Department’s argument centers on the court order issued in May 2022, which they characterize as a significant expansion of courts’ power to dismiss serious criminal charges based on subjective assessments of a prosecutor’s motivations. Abrego Garcia was charged last year with two counts of human smuggling, stemming from a traffic stop in Tennessee in November 2022. He was apprehended by state Highway Patrol and found to have numerous people in his vehicle. He pleaded not guilty.
Abrego Garcia is also currently involved in a separate federal case in Maryland, where immigration and customs enforcement is seeking to deport him to Liberia, but a federal judge has blocked that for now. The case involves a potential challenge to the deportation process, raising concerns about potential legal repercussions for Abrego Garcia.
The Justice Department’s request is part of a broader legal battle concerning the administration’s actions and the legal ramifications of the deportation proceedings.
