Manhyia South MP, Nana Agyei Baffour Awuah, has vigorously defended the New Patriotic Party’s record on corruption prosecutions, asserting that the NPP government has never utilized ‘nolle prosequi’ to shield appointees from prosecution. He responded to Majority Chief Whip Rockson-Nelson Dafeamekpor, who stated on JoyNews’ Newsfile that the NPP had previously employed this tactic, although he couldn’t recall the specific instances.

Mr. Awuah highlighted the prosecution and conviction of former Sports Minister, Alhaji Mallam Issah, under President John Agyekum Kufuor as compelling evidence demonstrating the party’s consistent stance against corruption prosecutions, stating that the NPP has never filed nolle prosequi in relation to appointees, former appointees, or persons sympathetic to the party, despite exposure.

His comments stem from the recent scrutiny of the AKSA Power transaction, following allegations by the United States Department of Justice that Goldman Sachs banker Tim Leissner Berko participated in a scheme to bribe Ghanaian government officials to secure and retain business linked to a power plant project in Ghana. Prosecutors allege that Mr. Berko was involved in the scheme between December 2014 and March 2017, while working for Goldman Sachs International. He was extradited to the US in July 2024 to face charges under the Foreign Corrupt Practices Act and money-laundering laws.

The Manhyia South MP emphasized the serious implications of these allegations, arguing that they raise questions about the integrity of public decision-making and Ghana’s capacity to effectively prevent and prosecute corruption domestically. He stated, ‘My sense of the judgment is that, but for the influence, certain approvals would not have been obtained.’

He further asserted that the alleged involvement of public officials made the matter particularly sensitive because they were responsible for decisions concerning the AKSA Energy deal. He pointed out that the allegations have exposed weaknesses in Ghana’s systems for ensuring value for money, preventing corruption, and prosecuting suspected offenders.

Mr. Baffour Awuah maintained that the NPP’s call for an inquiry into the AKSA transaction was justified and should result in concrete action. He stated that the inquiry should establish the facts surrounding the transaction, identify the officials involved, and determine whether any laws or procedures were breached. He also called for prosecutions where evidence of criminal wrongdoing is established, alongside reforms to address any institutional weaknesses uncovered by the investigation.

Furthermore, he underscored the need for the inquiry to provide a clear understanding of the transaction’s circumstances, including the individuals involved and whether any violations of regulations or procedures occurred. He concluded by advocating for a thorough investigation to promote accountability and prevent future compromises within the system. The inquiry’s objective is to ensure the protection of public funds and the integrity of governance within Ghana.”

The investigation into the AKSA Energy deal represents a significant challenge to Ghana’s efforts to combat corruption. The allegations suggest a potential for undue influence in critical decisions, which, if left unaddressed, could undermine public trust and economic stability. The NPP’s insistence on an inquiry is viewed as a vital step toward addressing these concerns and safeguarding the nation’s interests.”

This case underscores the need for robust oversight and accountability mechanisms within government and public institutions to prevent corruption and ensure responsible decision-making. Without proactive measures, the potential for corruption continues to exist, jeopardizing Ghana’s economic progress and social well-being. The consequences of inaction could be profound, potentially eroding public confidence and hindering the country’s development. The inquiry’s findings will be crucial in determining the extent of the wrongdoing and establishing appropriate sanctions.
