Judge Jeannette Vargas, an appointee of Democratic former President Joe Biden, issued the ruling on Friday in the Southern District of New York, stating the policy was ‘patently unlawful’ and conflicted with federal immigration law.
The policy, which categorically prohibits the issuance of immigrant visas based on nationality, represents a direct abrogation of this statutory scheme, according to Judge Vargas’s judgment. The ruling centers on the policy’s violation of the secretary of state’s authority to adjudicate immigrant visas, a core tenet of U.S. immigration law.
The suspension, implemented in January of this year, impacted applicants from Latin American countries including Brazil, Colombia, and Uruguay; Balkan nations such as Bosnia and Albania; South Asian countries like Pakistan and Bangladesh; and numerous nations in Africa, the Middle East, and the Caribbean. The Department of State has indicated that applicants from these countries are considered ‘at a high risk for becoming a public charge and recourse to local, state, and federal government resources in the United States.’
President Donald Trump has pursued an aggressive immigration crackdown during his presidency, arguing it’s aimed at enhancing domestic security. The Center for Constitutional Rights points to the freeze as part of a series of restrictions implemented following a broader travel ban affecting 39 countries, beginning January 1st, and a pause on diversity visa issuance in late December. Rights groups have raised concerns about potential violations of free speech and due process, particularly for minority groups, citing concerns about racial profiling.
The State Department has yet to issue a formal comment on the ruling.
