The legal landscape surrounding Sedina Christine Tamakloe-Attionu, the former Chief Executive Officer (CEO) of the Microfinance and Small Loans Centre (MASLOC), has taken a significant shift following a recent withdrawal by the Attorney-General of Ghana. A three-member panel of the Court of Appeal, presided over by Justice Emmanuel Ankamah, with Justices Samuel Obeng-Diawuo and Emmanuel Senyo Amedahe concurring, has now effectively halted the anticipated release of the acquitted former CEO. The decision, made in July this year, quashed her conviction and 10-year sentence on 78 corruption-related charges.

The court’s judgment, delivered by Justice Ankamah, was a pivotal moment in the case, establishing a crucial precedent concerning the defendant’s right to a fair trial. The Court, in a concurring opinion, forcefully rejected the prosecution’s argument that the trial judge had repeatedly shifted the burden of proof onto the appellant, a core tenet of the constitutional presumption of innocence. Specifically, the court emphasized that the prosecution had failed to meet its burden of proving several of the charges beyond a reasonable doubt, a standard essential to a successful conviction.

The Office of the Attorney-General and Ministry of Justice subsequently filed a notice of appeal at the Supreme Court on several hours after the judgment, citing dissatisfaction with the Court of Appeal’s decision to acquit and discharge the respondent. This appeal, however, was swiftly withdrawn by Principal State Attorney, Hilda Craig, who acted as a key player in the strategic maneuver.

The Attorney-General’s latest move centers around a motion for a stay of execution pending appeal, seeking the Court of Appeal to stay the execution of its judgment. This motion, delivered this morning, is aimed at compelling the Supreme Court to determine the appeal’s outcome before the prosecution can proceed with its action. The prosecution’s submission to the Supreme Court represents a dramatic reversal of the previous legal strategy.

Prior to the withdrawal, the prosecution had initiated a formal legal challenge, formally requesting the Court of Appeal to dismiss the case. However, the Court of Appeal’s ruling, while initially decisive, inadvertently established a critical hurdle. The withdrawal of the Attorney-General’s motion represents a calculated strategic shift, signaling a deliberate attempt to manage the legal process and potentially influence the outcome of the trial.
