The Court of Appeal has formally rejected an application brought by the Attorney-General to suspend the execution of its decision acquitting and discharging former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer, Christine Sedina Tamakloe-Attionu. The application, initially filed on August 10th, effectively terminated the proceedings before the appellate court, resulting in the withdrawal of the case. This decision follows the State’s earlier request for a temporary suspension of the acquittal, pending a further appeal.

The Attorney-General had argued that allowing the immediate effect of the acquittal could create an opportunity for Mrs. Tamakloe-Attionu to leave the jurisdiction, potentially hindering the appeal’s progress. Lawyers for the former CEO, however, contended that the Attorney-General should have sought permission from the court before withdrawing the application, particularly given the court’s scheduled ruling on the case for Wednesday, August 12th.

Sidney Antonio, counsel for Mrs. Tamakloe-Attionu, stated that the defense believes the proper procedure for the Attorney-General to seek leave of the court before withdrawing the application is to have done so. He further commented that today’s date was given by the court for the court to deliver its ruling, and that the defense believes the proper thing should have been for the Attorney-General to have sought leave of the court before going ahead and withdrawing because today’s business was for delivering of ruling and that should have gone on today.

The development is a significant shift in the case, occurring following the Court of Appeal’s recent decision to overturn the 10-year prison sentence imposed on Mrs. Tamakloe-Attionu in April 2024. The appellate court acquitted and discharged her after concluding that the prosecution had failed to prove its case. Mrs. Tamakloe-Attionu was convicted by the High Court on 78 charges, including theft, financial loss, money laundering, and imprisonment, and sentenced to 10 years’ imprisonment with hard labour.

The Attorney-General subsequently sought to stay the effect of the acquittal while pursuing a further appeal. The court’s ruling in the case of *[Insert Case Name]* established a precedent concerning the proper procedures for withdrawing applications, emphasizing the importance of seeking court permission before such actions. The appellate court’s decision establishes a crucial legal framework for handling such situations, ensuring a fair and transparent process for legal proceedings.

The decision has been met with significant scrutiny within the legal community, with observers noting the potential implications for future legal challenges and the continued importance of the Court of Appeal’s role in safeguarding the rule of law.
