Michael Bromwich, Hearn’s attorney, stated in a CBS News interview that the case’s resurgence is ‘truly difficult to understand.’ He emphasized the lack of evidence to support charges and asserted that the DOJ should prioritize pursuing actual criminal activity rather than continuing to engage in a protracted legal battle.

The discussions between the White House and the DOJ centered on the feasibility of reviving the case, with a primary focus on exploring alternative approaches to prosecuting Hearn. The DOJ is reportedly considering various strategies, including investigating the contractor responsible for the alleged installation and seeking a resolution that minimizes the legal and public attention surrounding the matter.

In a separate development, the D.C. Superior Court judge formally dismissed the case last week, leaving the ultimate decision on whether to dismiss with or without prejudice unresolved. The Justice Department is expected to provide further briefing on the case late this summer and early fall, potentially impacting the trajectory of the legal proceedings. The conversation between the White House and the Criminal Division occurred last week, and sources suggest the discussions were focused on whether there was a way to salvage the case, potentially as a misdemeanor, which would not require using a grand jury. The DOJ’s decision has ignited considerable political debate, with many observers speculating on the potential consequences for the former Olympian and the broader implications for the Justice Department’s strategy in the ongoing legal battle.
