The Africa Centre for Energy Policy (ACEP) has issued a sustained and increasingly urgent concern regarding the Turkish energy company AKSA Enerji’s involvement in Ghana’s agreement, tracing the worry back to 2015 – a period before the conviction of former Tema Oil Refinery (TOR) Managing Director Asante Kwaku Berko in the United States. This longstanding investigation, documented through extensive publications and analyses, underscores a deep-seated apprehension within the organization concerning the negotiation and execution of the AKSA power deal and its associated contracts. Established in 2015, ACEP’s primary focus has consistently revolved around identifying potential vulnerabilities within Ghana’s power procurement framework, particularly regarding the intricate structure of IPP contracts.

Mr. Benjamin Boakye, Executive Director of ACEP, stated that the organization’s vigilance has been continuous since 2015, meticulously tracking all relevant writings, publications, and reports pertaining to these Independent Power Producer (IPP) agreements. He emphasized that the concern wasn’t merely theoretical; it stemmed from a fundamental belief that certain contractual provisions, particularly those involving emergency power procurement, presented a significant risk of undue influence and potential compromise of national interests.

Specifically, Mr. Boakye highlighted that the complexity of some power contracts, particularly those negotiated under Ghana’s emergency power arrangements, raised questions about the potential for undisclosed financial inducements to influence decisions. He asserted, ‘But we couldn’t ascertain that it was merely one million, five thousand, twenty thousand that could be sacrificed to undermine our collective purpose and interest at that scale.’

The ACEP’s investigation extended beyond simple contractual analysis, acknowledging the potential for manipulative financial incentives to shape the agreement’s terms. Mr. Boakye underscored that the conviction of Asante Kwaku Berko, a former Goldman Sachs banker and former TOR Managing Director, served as a critical catalyst, triggering a broader review of Ghana’s power procurement processes. He stated that the need for immediate solutions should not come at the expense of national duty and interests.

In response to the recent developments surrounding the AKSA power deal, including the latest legal proceedings and scrutiny, Mr. Boakye has called for a comprehensive re-evaluation of Ghana’s current procurement arrangements. He contends that a thorough examination is crucial to determine whether existing contracts adequately safeguard the country’s financial well-being and to identify any safeguards that may have been overlooked. The ACEP’s assessment suggests a need for a fundamental re-evaluation of the negotiation and approval processes for the AKSA agreement, potentially necessitating adjustments to ensure transparency and accountability.

The organization has asserted that the recent developments provide an opportunity to rigorously examine how the contract was negotiated, and whether sufficient safeguards were put in place. This proactive stance reflects a commitment to safeguarding Ghana’s long-term energy security and political stability. The ACEP’s ongoing investigation represents a critical element in assessing the potential risks associated with the AKSA power deal and its implications for the nation’s energy strategy.
