The former Deputy Attorney General, Alfred Tuah-Yeboah, has issued a strong call for a meticulous examination of the entire trial record following the Sedina Tamakloe-Attionu case, asserting that the Court of Appeal’s judgment alone is insufficient to determine the merits of the case. Speaking on Asempa FM’s Ekosii Sen, Mr. Tuah-Yeboah emphasized the critical importance of reviewing all evidence presented before the High Court, arguing that a solely judgment-based assessment risks overlooking crucial details and potential errors. His perspective stems from a belief that the prosecution’s case against the former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer was fundamentally flawed without a comprehensive understanding of the entire trial proceedings. The case commenced in 2019, and by 2021, Ms Tamakloe had already been through several prosecution witness testimonies, with the High Court delaying the trial for over 16 months, a delay that Mr. Tuah-Yeboah views as a significant oversight. He stated that the court’s prolonged delay – exceeding 16 months – was a substantial issue that demands a thorough investigation into the trial’s entire progression. The High Court’s decision to acquit Ms Tamakloe-Attionu after a lengthy appeal, citing a lack of evidence beyond a reasonable doubt, represents a pivotal moment, and Mr. Tuah-Yeboah contends that the Court of Appeal’s judgment – and the accompanying record – must be scrutinized in its entirety. Specifically, he advocated for a comprehensive review of the High Court judgment, the full record of appeal, documentary evidence, and the forensic audit report, contending that the Court of Appeal’s decision is not the final word and that a thorough investigation is necessary to determine whether the Court correctly applied the law. He further refuted suggestions that the prosecution’s charge sheet was defective, asserting that each count contained sufficient particulars and that the trial revealed further complexities during the proceedings. Furthermore, he expressed his belief that the prosecution’s approach, while utilizing the charge sheet, was not sufficiently robust, highlighting that the evidence presented during the trial, in conjunction with the forensic audit, presented a complex picture that demanded a more detailed analysis. Mr. Tuah-Yeboah’s statement underscores the importance of a holistic assessment, advocating for a complete review of the evidence and the trial’s trajectory before any conclusions are drawn about the case. His comments are consistent with the Court of Appeal’s decision to acquit Ms Tamakloe-Attionu, which effectively overturned her conviction based on a failure to prove her case beyond a reasonable doubt, further highlighting the need for a thorough and comprehensive examination of the trial’s entire record.” , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , ,
