The Supreme Court’s recent ruling has been hailed as a critical reinforcement of the Office of the Special Prosecutor (OSP), bolstering the institution’s standing and bolstering public confidence in its mandate to combat corruption within Ghana’s legal system. Oliver Barker-Vormawor, a constitutional rights and policy strategy advisor at Democracy Hub, expressed significant optimism regarding the judgment, which was delivered on July 29, 2024, marking a pivotal moment in the nation’s anti-corruption efforts. The ruling, a unanimous decision from seven justices, affirms the constitutionality of the OSP Act, 2017 (Act 959), effectively ending a legal challenge to the agency’s establishment. The core of the decision centers on clarifying the relationship between the OSP and the Attorney-General, asserting that the Attorney-General remains the primary authority responsible for all state prosecutions. The Supreme Court’s judgment clarifies that Parliament, in enacting the legislation creating the OSP, possessed the constitutional authority to establish the agency to investigate and prosecute corruption and related offenses. Specifically, the court established that the Attorney-General retains the constitutional power to assume conduct of any prosecution initiated by the OSP, continue proceedings, or discontinue them by entering a nolle prosequi. This is a significant shift, with the ruling reinforcing the OSP’s institutional position and making it politically difficult for any future government to undermine its independence or operational effectiveness. Mr. Barker-Vormawor emphasized that this decision reaffirms the OSP’s central role in Ghana’s anti-corruption framework, and that the judiciary’s decision provides greater legal certainty regarding the agency’s functions. He stated that the judgment reinforces the importance of public and institutional support for the OSP, arguing that it strengthens confidence in its ability to investigate and prosecute corruption cases without undue constitutional challenges. The Democracy Hub advisor further highlighted that the ruling offers greater legal certainty regarding the OSP’s role, contributing to a strengthened framework for investigating and prosecuting corruption without potential for future constitutional uncertainty. The ruling, he noted, underscores the importance of the OSP as a cornerstone of Ghana’s anti-corruption efforts and its continued importance in upholding the nation’s legal and ethical standards.
