The Intercept and the nonprofit Freedom of the Press Foundation have initiated a formal lawsuit against United States President Donald Trump, demanding a federal ban on his social media service from offering advance access to his posts. The lawsuit, filed on Wednesday, centers on a proposed subscription-based service – dubbed ‘Truth API’ – which would restrict access to matters of public interest, sparking intense scrutiny of the Trump Media and Technology Group’s business practices.

Court filings detail the plaintiffs’ argument that the service would violate the President’s constitutional right to free speech and the First Amendment’s guarantee of equal access to the President’s public announcements. The complaint asserts that the subscription service constitutes a deliberate attempt to financially benefit Trump by providing market-moving information to those willing to pay his personal company’s access.

The lawsuit cites the right to a free press under the US Constitution, arguing that the plan would infringe upon the President’s ability to communicate freely without restriction. It further contends that the service would violate the Fifth Amendment’s protections, restricting the government’s ability to charge arbitrary sums to access government information.

The complaint names Trump as a direct party and White House aide Natalie Harp and Deputy Chief of Staff Daniel Scavino, alleging that the service’s core function is to offer real-time access to Trump’s posts and accounts on Truth Social. More than 10 customers had already subscribed as of an August 10 earnings call, highlighting the significant investment made in the service.

Furthermore, the lawsuit contends that Trump’s utilization of Truth Social to announce policy changes, particularly regarding the US-Israel war on Iran, demonstrates a pattern of leveraging government information for potential economic impact. Experts have noted Trump’s comments on the conflict have sent ripples through global oil markets, highlighting the potential for significant financial repercussions.

Trump Media and Technology Group, the company behind Truth API, charges subscribers between $60,000 and $100,000 a month for access to Trump’s posts and other prominent accounts on the platform. The service, launched in July, has already garnered over 10 subscribers, raising concerns about the potential for widespread use and the impact on the platform’s revenue.

Critics are raising concerns that Trump uses his Truth Social account to announce policy changes that could have significant economic repercussions. Trump’s comments, for instance, regarding the US-Israel war have been interpreted as potentially destabilizing global markets. The White House has yet to issue a formal comment on the dispute.

The lawsuit is currently scheduled to be heard in a federal court in the Southern District of New York. Legal experts suggest this case could have broad implications for the future of social media regulation and the balance of power between the government and private platforms.
