President of the Young Lawyers Forum of the Ghana Bar Association, Noah Ephraem Adamtey Tetteh, has vehemently challenged the assertion that vacation courts do not conduct trials, initiating a significant controversy within the legal community. He stated that this position is ‘quite problematic’ and contradicts established legal principles, particularly concerning the practical realities of proceedings before vacation courts. Speaking on Joy News’ PM Express, Mr. Tetteh detailed his concerns, arguing that the notion is incongruent with observed practice and legal understanding, emphasizing a fundamental divergence between procedural matters and substantive legal challenges. His comments stem from a broader debate surrounding the Chief Justice’s directive, which has recently focused on certain cases being heard during vacation periods. The core of the disagreement centers on whether vacation courts are limited to interlocutory matters, motions, or emergencies, or whether they can encompass substantive issues including trials. Mr. Tetteh underscored that the distinction between procedural and substantive issues is often blurred, particularly when considering judgments on admission and other forms of judicial proceedings. He highlighted a key point: the necessity of differentiating between what constitutes a merely procedural activity and a substantive legal challenge. He further pointed out that the Chief Justice’s directive – specifically concerning former National Signals Bureau boss Kwabena Adu-Boahene and others – necessitates a nuanced analysis. Mr. Tetteh asserted that the Chief Justice possesses the authority under Ghana’s laws to direct specific actions, and that this power should not be used to diminish judicial independence by allowing judges to circumvent established procedures and judicial discretion. He emphasized that the Chief Justice’s directive is a crucial distinction, and that the Chief Justice’s authority to direct cases to be heard is a fundamental aspect of the judicial process. He concluded by stressing the importance of adhering to established legal principles and safeguarding the integrity of the judicial system, stating that the vacation courts’ restricted role is problematic and potentially detrimental to the administration of justice. The debate highlights a complex interplay between procedural matters and substantive legal challenges, raising fundamental questions about the scope of judicial authority and the proper application of legal principles. The issue is further complicated by the Chief Justice’s directive, which concerns specific cases, and the need to distinguish between matters that require a trial and those that are handled through vacation courts.
