The former Deputy Attorney General, Alfred Tuah-Yeboah, has underscored the critical importance of a comprehensive assessment of the entire trial record when evaluating the Sedina Tamakloe-Attionu case, particularly concerning the Court of Appeal’s judgment. His argument, as articulated on Asempa FM’s Ekosii Sen, highlights a fundamental principle: that the prosecution’s case against the former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer, Sedina Tamakloe, must be scrutinized with the full weight of the High Court’s proceedings before any conclusions can be drawn.

Mr. Tuah-Yeboah contends that relying solely on the Court of Appeal’s judgment presents a significant risk of misinterpretation. He asserted that a thorough examination of all evidence, including witness testimonies, prosecution documents, and forensic audit reports, is essential to determine whether the Court of Appeal’s decision was fundamentally flawed. Specifically, the trial commenced in 2019, and by the time Ms. Tamakloe departed for abroad in 2021, several prosecution witnesses had already testified.

He explained that the High Court’s protracted delay in allowing the trial to proceed – a delay exceeding 16 months – underscores the need for a meticulous review of the proceedings. The court’s decision to serve Ms. Tamakloe through substituted service and publication, as detailed in his statement, demonstrates a deliberate effort to avoid jurisdictional challenges. Furthermore, the prosecution’s failure to file a submission of no case to answer, a move that the co-accused challenged, was ruled by the court to be a valid challenge.

Prior to joining the Attorney General’s Department, Mr. Tuah-Yeboah outlined the sequence of events leading to Sedina Tamakloe’s conviction. The case commenced in 2019, and the court’s decision to proceed with the trial by the time Ms. Tamakloe left for abroad in 2021, meant that nearly five witnesses had already testified.

He emphasized that the High Court’s extended delay – exceeding 16 months – necessitated a protracted period of legal proceedings, including the provision of substituted service and publication, which significantly impacted the trial’s timeline. The court’s decision to acquit and discharge Ms. Tamakloe after ruling that the prosecution had failed to prove its case beyond a reasonable doubt, effectively overturning her earlier conviction by the High Court, underscores the importance of a thorough investigation. His perspective is further supported by the Court of Appeal’s clear ruling, which established that the prosecution had failed to meet its burden of proof.

He rejected suggestions that the charge sheet itself was defective, asserting that each count contained sufficient particulars and that the trial uncovered additional details that emerged during the proceedings. His comments reflect a commitment to ensuring the full and accurate interpretation of the legal proceedings. The Court of Appeal’s decision to acquit and discharge Ms. Tamakloe is a significant development, reinforcing the principle that a robust legal review of the trial record is paramount to any assessment of the case’s legitimacy. The case serves as a critical reminder of the potential for prosecutorial errors, highlighting the significance of thorough trial record examination to safeguard the rights of all parties involved.”

“The challenges to the prosecution’s case are significant, and a thorough examination of the trial record is vital to accurately assess the outcome and ensure a fair legal process,” added the statement.
