The National Democratic Congress (NDC) has ignited a significant controversy following the NPP’s Deputy Director of Elections and IT of the party, Rashid Tanko Computer,’s criticism of Bernard Antwi-Boasiako, popularly known as Chairman Wontumi, pursuing the New Patriotic Party’s (NPP) National Chairmanship position while serving a 20-year prison sentence.

Mr. Tanko’s comments, delivered in a recent interview, directly challenge the NPP’s decision, questioning how a person serving a lengthy custodial sentence can effectively lead a political party and suggests a potential lapse in due process.

According to Mr. Tanko, the situation is deeply concerning, highlighting a potential lawlessness within the NPP. He contends that the leadership’s decision to grant Wontumi the position, particularly considering his 20-year imprisonment, raises serious questions about the integrity of the party’s organizational structure and the application of its constitutional provisions.

This critique stems from the NPP’s own constitution, which outlines a stringent disqualification process for members convicted or sentenced for offenses involving matters of illegal mining activities at the Samreboi concession in the Western Region. The constitution stipulates that a member is disqualified from holding office or contesting elections if convicted and/or sentenced by a court of competent jurisdiction for certain offences.

Specifically, Article 3(5)(1)(b)(ii) of the 2025 amended and ratified Constitution defines disqualification based on a court’s judgment for offenses punishable by death or a sentence of not less than 10 years, unless 10 years have elapsed after the member served the sentence or the member has been granted a full pardon.

This provision explicitly addresses cases involving offenses punishable by death or a sentence of 10 years or more, further emphasizing the gravity of the situation.

Furthermore, the legal battle centers around the fact that Mr. Boasiako’s current conviction, totaling 20 years, surpasses the 10-year threshold stipulated by the NPP’s own rules. The legal appeal centers on whether the NPP’s electoral authorities will resolve this matter before allowing Wontumi to remain as NPP National Chairmanship candidate.

The NDC has responded to the criticism by affirming the constitution’s provisions regarding disqualification for convicted members, stating that the legal challenge is a matter of considerable importance and requires careful consideration. The party’s legal team is currently evaluating the constitutional provisions to determine the appropriate course of action, which includes resolving the eligibility question before allowing Wontumi to proceed.

Mr. Tanko’s statement underscores the growing tension within the NPP, potentially threatening the party’s stability and raising concerns about the fairness and legitimacy of the leadership’s decision-making process. The legal ramifications of this situation are significant and could have far-reaching consequences for the NPP’s future.

Sources confirm that the NPP’s legal counsel has expressed concerns regarding the potential for a disqualification, suggesting a need for a thorough review of the constitutional provisions. The legal experts are examining the constitution to determine the exact legal framework for handling such a situation.

This incident serves as a stark reminder of the potential for legal challenges and the delicate balance between upholding the law and preserving party integrity within the NPP.
