Waseem al-Assad, a former member of the al-Assad regime, has been sentenced to death for crimes committed during the Syrian Civil War, marking a significant development in Syria’s transitional justice process. His sentence, handed down on Tuesday, represents a culmination of investigations into alleged atrocities committed during the 14-year war, particularly concerning militia activities and the trafficking of Captagon, a precursor drug used in the production of amphetamines. The charges against him include premeditated murder and torture, classified as crimes against humanity and war crimes. Syria’s court system, under the leadership of President Ahmed al-Sharaa, initiated this trial following a request from the Fourth Criminal Court, established to investigate the regime’s past actions. Al Jazeera’s Obaida Hitto reported from outside the court, noting that the prosecution centers on alleged involvement in the abduction and killing of Syrians, targeting Eastern Ghouta, a region that became a significant rebel stronghold and a major humanitarian crisis during the conflict. The trial, which began in June 2025, has been a subject of considerable international attention, fueled by concerns over the regime’s legacy and the potential for accountability for those responsible for widespread civilian casualties. According to a report by the United Nations, Syria lost an estimated 300,000 lives during the war, with over 22 million people displaced, primarily to neighboring countries. Wassim al-Assad, born in Latakia, Syria’s Mediterranean coast, is a cousin of Bashar al-Assad, who was ousted in a rebel advance on Damascus in December 2024. He has been living in exile since then, primarily under Russian supervision, and has been accused of overseeing the production and smuggling of Captagon, a key revenue source for the regime, as well as facilitating the movement of Syrian refugees. The court found him guilty of multiple murders and the ‘murder accompanied by torture and brutality’ classification, indicating a deliberate pattern of violence. The sentence includes confiscation of his assets and a lengthy arrest period, highlighting the legal efforts to address the regime’s past actions. In addition to the death sentence, the court ordered the confiscation of al-Assad’s assets, reflecting a determination to hold those responsible accountable. The trial’s ongoing nature has been viewed as a crucial step in Syria’s transition to justice, though the process has faced criticism regarding the length of time elapsed since the war’s conclusion. The government’s initial response to the conflict was criticized as lacking sufficient urgency, and the Fourth Criminal Court was tasked with bringing perpetrators of human rights abuses to justice. A key aspect of the trial is the continued investigation into the fate of Najib, who was sentenced in person in January 2025 after being detained in detention following accusations of brutal crackdown on protesters in Deraa in 2011. Najib was charged with at least 10 crimes, including murder, torture, and overseeing massacres, further complicating the situation. The court’s ruling also included a challenge to the former security official’s long-standing accusations of orchestrating the civil war, suggesting a potential link between his actions and the conflict’s origins. The trial has drawn scrutiny from international human rights organizations and observers, with concerns about the potential for the ruling to influence future justice proceedings. The legal proceedings continue, with a focus on establishing accountability for the atrocities committed during the Syrian Civil War, and the implications for the future of Syria.
