The ongoing trial of Diddy, who faces criminal charges related to a past assault lawsuit, is now being strategically utilized in a new legal maneuver designed to re-engage the case against his son, Christian ‘King’ Combs. Grace O’Marcaigh’s attorneys, representing the plaintiff, have revised their case after a previous dismissal by the court, citing a crucial flaw in the original jurisdiction determination. Their revised argument centers on the evidence from Diddy’s federal criminal trial – evidence that, according to the revised strategy, helps establish a direct link to California, a state the original complaint was missing. This shift in focus aims to bolster the plaintiff’s claim that Christian’s actions constitute sexual assault.

The original lawsuit, initially dismissed by the court, revolved around a December 2022 encounter aboard a yacht where Grace O’Marcaigh was working as a steward. She alleges Christian cornered her in the vessel’s cinema after earlier making unwanted advances and attempting to force her to perform oral sex. Christian vehemently denies these allegations. The lawsuit also sought to hold his father responsible, arguing that Diddy chartered the yacht and controlled the environment onboard. The court initially found that O’Marcaigh had not established sufficient connection between Diddy and California to keep him as a defendant, a finding that prompted the amended complaint. The new filing incorporates testimony from former employees, notably Brendan Paul, who described the extent of Combs’ control over his staff and the preparation of private gatherings known as ‘Wild King Nights.’

Crucially, the amended complaint also delves into evidence developed during Diddy’s 2025 criminal trial. A key piece of evidence is testimony from former assistant Brendan Paul, who testified that staff members were expected to prepare rooms for those encounters and handle related supplies. He also described an operation in which assistants were expected to anticipate Combs’ needs and remain available while traveling. O’Marcaigh’s attorneys are now leveraging this testimony to support their argument that Combs maintained close control over his surroundings even when away from home. This corroborating evidence, they contend, strengthens the plaintiff’s claim that Diddy acted with a degree of control over events aboard the yacht. The judge’s decision on whether this new evidence is sufficient to overcome the earlier dismissal remains to be determined.

However, Diddy’s legal team has countered with a strategy to redirect the court’s attention. In July, they initiated sanctions against O’Marcaigh and her legal team, arguing that the amended complaint merely repackaged arguments already rejected by the court. The judge, however, explicitly authorized the amendment, asserting that the new allegations provide additional factual connections linking Combs to California. The September 4 hearing is anticipated to be a pivotal moment as the judge will decide whether Diddy can remain in the lawsuit under the revised allegations.

Christian remains a defendant in the O’Marcaigh case, regardless of the jurisdiction dispute surrounding his father. A September 4 hearing is scheduled to address whether Diddy can remain in the lawsuit under the amended allegations.
