Ghanaian lawyer, Bobby Banson, has sharply criticized the escalating trend of individuals using social media to inflict irreparable harm on the reputations of public figures, arguing that the principle of freedom of speech should not be used as a justification for malicious attacks. Banson, in a recent interview with JoyNewsfile on Saturday, September 25th, voiced his concerns about the deliberate dissemination of false information, claiming that individuals often engage in these behaviors without regard for potential consequences. He stated, “Between 2000 and 2026, people are becoming more intentional about saying things that they know are false that affect the social fiber… so people do these things for whatever they want, knowing that there is no criminal punishment.”

Banson’s perspective underscores a growing anxiety regarding the potential for online defamation and the erosion of trust. He explicitly rejected the notion that freedom of speech allows individuals to denigrate public figures, highlighting the potential for such actions to inflict significant harm on reputations. He emphasized the importance of protecting individuals who hold public office, arguing that freedom of speech should not be extended to protect those who deliberately spread false information with malicious intent. He described the situation as unacceptable and revealed that he had personally been a victim of such attacks, adding weight to his argument about the need for accountability.

His comments come amidst a broader national debate concerning the appropriate response to harmful online content. The detention of nurse Salomey Awiti Bafoh, who is currently facing charges related to publishing and circulating false information through a TikToker, has intensified this discussion. The allegation, before the courts, has prompted a call for restraint in handling speech-related cases. President John Dramani Mahama has repeatedly emphasized the importance of restraint in addressing such issues, issuing a letter to the Media Foundation for West Africa and the Ghana Journalists Association, urging stakeholders to consider alternatives to arrest and prosecution where online content does not involve threats, incitement, violence, or other clearly criminal conduct. He stressed that legitimate criticism, political commentary, satire, and dissent should not be criminalised. The President also urged a national discussion on TikTok and other new media platforms, suggesting that a more measured approach is needed to address the challenges posed by these evolving technologies.

Banson’s remarks reflect a broader concern about the impact of social media on societal trust and the importance of maintaining a balance between freedom of expression and accountability. He underscored the need for a renewed focus on establishing clear guidelines for online behavior and protecting individuals from the potentially devastating consequences of unchecked misinformation. The situation underscores a critical juncture where the lines between legitimate criticism and harmful defamation are increasingly blurred, demanding careful consideration of the legal and ethical implications of online discourse. He stated, ‘It’s crucial to understand that the very act of deliberately spreading falsehoods, knowing there’s no consequence, can have a profound and lasting impact on individuals and communities.’

This incident highlights the challenges of regulating online content while upholding fundamental rights to freedom of speech. The debate surrounding accountability and the potential for online harm remains a central focus of discussions within Ghana and beyond, prompting ongoing analysis of best practices for safeguarding public discourse and protecting individual reputations in the digital age.
