The original intention, according to government officials, was to streamline the judicial process and reduce the burden of individual magistrates. However, critics argue that this expanded scope creates a powerful, unaccountable power structure that could easily be exploited, compromising the independence of the judiciary and potentially undermining the rule of law. The initial reaction from the opposition party, the Progressive Alliance, has been swift and scathing. Leading member of the party, Samuel Agyenne, stated in a press conference, “This law is a dangerous precedent. It undermines the very foundations of our judicial system. The concentration of power in these hands is alarming, and we must ensure that the judiciary remains truly independent.” He further added that the government has failed to adequately address the concerns raised by civil society groups, suggesting a lack of genuine consultation.

The Ghana Police Service has confirmed that they have launched an investigation into the alleged irregularities surrounding the vetting process. Inspector General of Police, Raphael Nkrumah, acknowledged the situation, stating, “We are taking this matter very seriously and are committed to ensuring that the law is applied fairly and impartially. We are working with the relevant authorities to fully understand the situation and to take appropriate action.” However, the police’s response has been largely focused on monitoring the activities of the ‘Special Prosecutors’ rather than investigating potential breaches of the law.

The public tribunal law is currently under intense legal challenge, with numerous legal challenges expected to be filed in the coming days. The legal battle will undoubtedly center on questions of judicial independence, accountability, and the fundamental principles of the rule of law. The upcoming hearing of the case is anticipated to be a pivotal moment in Ghana’s ongoing struggle to preserve the integrity of its judicial system.

The ramifications of this legal upheaval extend far beyond the courtroom. The public trust in the judiciary, and in the rule of law itself, is currently at a critical juncture. The chaotic vetting process and the emergence of the Special Prosecutor’s Persons of Interest network represent a significant threat to the stability of the country’s legal system.
