Parliament has formally approved the appointment of three Justice-designates to the Supreme Court, a move that has ignited significant debate and opposition from the Minority Caucus, a significant portion of the legislative body. The decision, finalized after a lengthy committee review and subsequent House vote, represents a pivotal moment in the judiciary’s composition, following weeks of heated discussions and maneuvering.

The approval came following a lengthy committee process, culminating in a recommendation from Chairman Bernard Ahiafor to adopt the committee’s report and approve the appointments. The three nominees – Justice Edward Amoako Asante and Justice Sophia Rosetta Bernasko Essah, both Justices of the Court of Appeal, and Anthony Forson Jr., a private legal practitioner – were selected by majority decision at both the committee and plenary levels. The appointment was a result of a contentious debate within the Appointments Committee, where the Minority Caucus initially raised preliminary objections to the vetting of the nominees during the public hearing.

Mr. Ahiafor explained that the Minority’s objections, initially presented during the hearing, were addressed but ultimately led to a withdrawal of the committee’s members from the process. He emphasized that following the vetting process, the majority of members present and voting recommended that the House approve the nominees, adhering to the constitutional requirements outlined in Article 104 of the Constitution.

The Minority Leader, Alexander Afenyo-Markin, addressed the House directly, asserting that the Caucus’s opposition was not rooted in a desire to undermine the judicial process, but rather a disagreement with the appointment process itself. He stated that the two ministerial nominees and three nominees for appointment as Justices of the Supreme Court were referred to the Appointments Committee on Monday. He stressed that the Emergency Recall of Parliament, which concluded today, left the committee with only three working days to vet five nominees for two of the most consequential classes of offices in the Republic. He specifically pointed out that the Minority raised a preliminary objection before a single question was put to the three judicial nominees, and that objection was dismissed by the Chairman of the committee.

The Minority Caucus’s objection, as Mr. Afenyo-Markin stated, was not directed at the nominees themselves, but rather at the character, competence, and standing of each individual. The Caucus urged the House to refrain from portraying the Minority’s objection as opposition to the nominees, emphasizing that the objection is purely based on constitutional requirements and the standing orders of Parliament.

The nine grounds on which the Minority raised their preliminary objection, as detailed in the Committee’s report, encompassed a broad range of constitutional provisions and parliamentary procedures. The House subsequently approved the three nominees, effectively enacting the recommendations of the Appointments Committee. The decision has sparked considerable discussion about the balance of power within the judiciary and the potential impact on the judicial system, with many observers expressing concern about the implications of this significant appointment.
