Parliament has formally approved the appointments of three new Justices of the Supreme Court, a decision that has ignited significant debate within the country’s judicial system following a protracted and contentious vetting process.

The approval follows a recommendation by the Appointments Committee, which detailed the meticulous process undertaken to identify suitable candidates for the apex court. Following a period of intense deliberation, the committee adopted a report outlining the nominees’ qualifications and experience, ultimately recommending Sophia Rosetta Bernasko Essah, Edward Amoako Asante, and Anthony Forson Jnr for consideration.

The appointment comes against the backdrop of a significant challenge from the Minority Caucus, led by Alexander Afenyo-Markin, who vehemently opposed the expedited vetting process. Mr. Afenyo-Markin argued that the accelerated timeline was unnecessary, citing no vacancies on the bench requiring immediate replacement.

His objection centered on the procedure itself, asserting that the Minority’s concerns were not directed at the nominees’ individual qualifications but rather at the committee’s decision-making process. He subsequently led the Minority members out of the Appointments Committee, after the committee chairman, Bernard Ahiafor, rejected his objection and ruled that the vetting should proceed.

Mr. Ahiafor dismissed Mr. Afenyo-Markin’s arguments as ‘flimsy,’ ‘hollow’ and ‘baseless,’ effectively paving the way for the Majority side of the committee to continue with the exercise of the appointment process.

Three distinguished nominees have been selected for the Supreme Court, each bringing a wealth of experience from both the judiciary and private legal practice.

Justice Sophia Rosetta Bernasko Essah is a Justice of the Court of Appeal with extensive judicial experience, having been previously considered for the Supreme Court in 2024 but not completing the appointment process before the change in administration.

Justice Edward Amoako Asante, a Court of Appeal Justice, possesses significant regional judicial experience, having previously served as President of the ECOWAS Court of Justice before returning to Ghana’s Court of Appeal.

Anthony Forson Jnr, a private legal practitioner and former President of the Ghana Bar Association, brings extensive legal expertise to the proposed Supreme Court bench, representing a crucial element in the judicial system.

The approval of these three nominees is expected to have a considerable impact on the country’s legal landscape and the stability of the judicial apparatus, as the appointment process continues to be closely monitored by stakeholders and legal experts.
