The ongoing investigation into the Aksa Scandal, a significant breach of contract involving Anglo-American Oil Services (AKS) and Ghana’s Oil and Gas Regulatory Authority (OGRA), has recently seen a significant escalation in public scrutiny, largely focused on the capacity of the Office of the Special Prosecutor (OSP) to effectively manage the probe. Kissi Agyebeng, the Minister of Mines and Energy, has addressed these criticisms directly in a televised press conference on Tuesday, November 1st, 2024, offering a detailed explanation of the OSP’s strategy and the steps taken to ensure a thorough and impartial investigation. The initial report, released by the Ghana Economic and Financial Intelligence Services (GEFIS) on October 26th, highlighted concerns regarding the OSP’s limited resources and potential bottlenecks in the investigation. Agyebeng, however, emphasized that the OSP has been diligently working to maximize its capacity to navigate the complexities of the case.

Prior to this meeting, GEFIS had presented a preliminary assessment suggesting the OSP’s current caseload was a significant constraint, potentially hindering the investigation’s progress. The Minister acknowledged this concern during the conference, stating that the OSP is working towards streamlining processes and allocating resources strategically. He reiterated that the OSP is committed to adhering to the legal framework and ensuring a transparent and accountable process.

Specifically, Agyebeng outlined the key elements of the OSP’s approach. Firstly, the Minister emphasized the implementation of a new data management system, dubbed ‘Project Chimera,’ designed to consolidate and analyze information from various sources, including AKS’s financial records, OGRA’s reports, and legal documents. This system, he explained, will facilitate a more holistic and comprehensive understanding of the events leading up to the scandal.

Secondly, Agyebeng highlighted the deployment of a dedicated investigative team comprised of experienced forensic accountants, intelligence analysts, and legal experts. He stated that this team, consisting of approximately 30 individuals, will be tasked with conducting a detailed forensic audit of AKS’s operations, identifying potential financial irregularities, and tracing the flow of funds. The Minister further stressed the importance of utilizing advanced data analytics to uncover hidden connections and patterns.

Regarding the OSP’s investigative powers, Agyebeng acknowledged the limitations imposed by the existing legal framework. He explained that the OSP operates under a constrained mandate, requiring the consent of the Attorney-General and the High Court, which, he stated, has been used judiciously to ensure judicial oversight and prevent any potential interference with the investigation. However, Agyebeng emphasized the OSP’s commitment to utilizing all available legal tools and resources to achieve its objectives.

During the press conference, Agyebeng addressed the criticism of the OSP’s reliance on external investigations, particularly regarding the involvement of former AKS employees. He acknowledged this concern, stating that the OSP is actively pursuing all avenues to identify and interview relevant individuals, including utilizing public records and collaborating with relevant law enforcement agencies. He assured the public that the OSP is committed to transparency and will release findings as they become available, adhering to established legal procedures.

The Minister also addressed the concerns regarding the potential for delays in the investigation, attributing these to the complexity of the case and the need for thorough data analysis. He stated that the OSP is working diligently to expedite the process and minimize any disruption to the investigation timeline. He highlighted the importance of maintaining a consistent and focused approach throughout the investigation.

The OSP is currently analyzing a significant volume of data, including AKS’s financial statements, contract agreements, and correspondence, aiming to pinpoint the precise sequence of events leading to the scandal. The Minister reiterated that the investigation is being conducted with the utmost diligence and professionalism, guided by the principles of legal integrity and accountability. He stated that the OSP will continue to provide regular updates on the progress of the investigation, ensuring public confidence and transparency.

The government has also pledged its full support for the investigation, emphasizing that it is committed to ensuring a just and equitable resolution for all stakeholders involved. Agyebeng concluded by reiterating the OSP’s dedication to upholding the rule of law and preventing future breaches of contract. The Minister reiterated that the OSP’s objective is to establish a definitive understanding of what transpired and to deter similar occurrences in the future. The legal team is working on ensuring all evidence is properly preserved and that the investigation adheres to all applicable laws and regulations.

Looking ahead, Agyebeng stated that the OSP will prioritize the identification of potential financial losses and the recovery of assets acquired through the unauthorized transactions. He also emphasized the importance of securing the assets of those involved and ensuring that the investigation does not impede legitimate business activities. The Minister concluded by stressing the importance of a swift and decisive resolution to the case, which he believes is crucial for maintaining investor confidence and safeguarding Ghana’s financial stability. The OSP is currently conducting a thorough review of its operational procedures to improve efficiency and effectiveness. The Minister expressed confidence that the investigation will be completed expeditiously, ensuring a transparent and accountable process. The investigation is expected to continue for several months, with regular updates to the public.
