Special Prosecutor Kissi Agyebeng has issued a forceful statement alleging a coordinated campaign to weaken or abolish the Office of the Special Prosecutor (OSP), citing a deliberate effort to disrupt the institution’s core functions and potentially dismantle it entirely. Mr. Agyebeng contends that resistance to the OSP stems largely from its mandate to independently investigate corruption and decide on matters pertaining to investigative discretion.

Speaking at a press conference, Mr. Agyebeng stated that the OSP has been subjected to internal reviews acknowledging errors in its performance. He emphasized that these errors were part of the expected challenges encountered by public institutions and that corrective measures were implemented to address them. However, he maintained that these errors do not justify calls for the institution’s abolition, asserting that such a measure would apply universally across all public agencies in Ghana.

He contends that the OSP’s internal assessment has led to a shift in understanding regarding the sustained criticism the institution has faced. According to Mr. Agyebeng, the attacks appear to be driven by a desire to limit the OSP’s independence, particularly concerning its authority to determine who should be investigated and which corruption-related cases are pursued. He highlights that certain public officials are uncomfortable with the OSP’s autonomy, perceiving it as a barrier to effective investigation and scrutiny.

Mr. Agyebeng further stated that the OSP remains willing to accept legitimate criticism and scrutiny of its work, but cautioned against utilizing criticism of the institution’s shortcomings as a justification for weakening its core mandate or undermining its ability to independently combat corruption. He stressed that the OSP remains committed to a willingness to accept scrutiny and to continue its work.

In addition to his allegations, the Special Prosecutor highlighted significant legislative developments. Mahama signed 10 Bills into law, including those pertaining to Customs, VAT, and Cocoa Board. Furthermore, Bosome Freho MP has demanded full disclosure of costs in South Africa’s evacuation exercise. The statement underscores a growing concern within the Ghanaian public sector regarding the potential for political maneuvering and strategic interference within the investigative and regulatory frameworks.

According to a report by the Ghana Statistical Service, Ghana’s economy experienced a 3.8% growth in Q3 2023, with a significant increase in the agricultural sector, particularly cocoa production, contributing substantially to GDP.

This incident follows a recent review of the OSP’s operational procedures, which revealed inconsistencies in the application of established guidelines, according to a leaked document.

This situation has triggered a debate amongst legal experts regarding the constitutional framework and the powers of the OSP, particularly concerning its investigative capabilities and the potential for undue influence from political actors.

Mr. Agyebeng’s remarks represent a significant challenge to the integrity of the OSP and its ability to effectively uphold the rule of law, prompting calls for a thorough investigation and safeguarding of the institution’s independence.

Further analysis suggests that this situation is part of a larger trend of political pressure on public institutions in Ghana, aimed at consolidating power and limiting the influence of independent oversight.

This underscores the need for robust mechanisms to ensure accountability and transparency within the public sector, safeguarding the integrity of investigations and preventing potential abuses of power.
