Australia has enacted a landmark ban on fully AI-generated music from the Australian Recording Industry Association (ARIA) charts, marking a significant escalation in the ongoing debate surrounding artificial intelligence and creative technology. The decision comes after a recent surge in AI-assisted music, specifically a cover of Madonna’s ‘Like a Prayer’ by Queensland DJ Josh Fawaz, which dominated Australian radio and charted at number four on two ARIA charts in July. This move directly follows a hard line drawn in the sand by ARIA, establishing the first major territorial restriction on AI-generated tracks.

The updated Charts Code of Practice allows recordings utilizing AI in a supporting role to remain eligible, but any wholly generated by artificial intelligence is explicitly blocked. This policy was finalized by Aria CEO Annabelle Herd, who emphasized the organization’s intention to ‘give everyone who releases music in Australia a clear rule to work to’ and urged radio stations and streaming platforms to ‘support human artistry’ across their own operations. The ban is aligned with principles released by the International Federation of the Phonographic Industry (IFPI) in July, which suggest that lead vocals or key instrumentals created by AI would disqualify tracks from global charting.

Meanwhile, the United States has adopted a markedly different approach. Major record labels are exploring guidelines for AI music eligibility, but there is no blanket ban on Billboard charts or other US chart systems. The focus remains on authorization and copyright compliance rather than outright exclusion. Spotify has taken a middle-ground approach by badging AI personas and excluding them from recommendations by default, though this applies only to artist profiles, not individual tracks. This has fueled tension with Australia, where the ban is considered a direct response to the surge in AI-generated music.

The recent comments from Dr. Dre, a legendary producer and staunch critic of AI, further complicate the situation. In a New York Times interview, Dr. Dre stated, ‘The only people that see it as a threat are the people who have trouble creating,’ comparing AI to drum machines and synthesizers that revolutionized music decades ago. He emphasizes that he doesn’t view AI as a threat to artistry, instead viewing it as a tool that can be used creatively.

Experts suggest this move reflects a growing concern about the potential impact of AI on the creative industries. The debate highlights a complex interplay between technological advancement and artistic expression, raising fundamental questions about the future of music creation and the role of human creativity in the digital age. The ramifications of this ban will undoubtedly be felt across the Australian music landscape and beyond, as the industry grapples with the implications of this new regulatory framework.
