The criminal case involving Solomon Asamoah, former Chief Executive Officer of the Ghana Infrastructure Investment Fund, and Prof. Ameyaw-Akumfi, Board Chairman of the Ghana Infrastructure Investment Fund, concerning the abandoned Ghana Sky Train project, has recently taken a significant and contentious turn. The development was disclosed by Justice Srem-Sai, Deputy Attorney General and Minister for Justice, who stated that both accused persons have yet to formally file their defenses despite a period of 42 days to do so. This delay has sparked considerable scrutiny within the legal community.
Following the trial court’s dismissal of Asamoah’s arguments regarding a lack of case and a request for a stay of proceedings, the Supreme Court granted another 21-day period to file defenses. This extended the overall period to 42 days, culminating in a new court hearing on Monday, August 24th. Subsequently, lawyers for Asamoah filed two applications before the Supreme Court.
Firstly, they sought an order of certiorari to quash the trial court’s ruling dismissing his challenge to his submission of no case and his existing bail conditions. Secondly, they requested an interlocutory injunction to halt the proceedings pending the outcome of the certiorari application.
Justice Srem-Sai emphasized that the two accused individuals have not yet presented a formal defense. The application for a stay of proceedings is scheduled to be heard by the Supreme Court on Thursday, August 27th.
