This case, brought by Member of Parliament for Ofoase-Ayirebi, Kojo Oppong Nkrumah, centers on a dispute regarding the legality of allowing selected criminal cases to proceed during the vacation period. He stated, ‘The Chief Justice heads an independent organ of the state, the judiciary. We have the judiciary, the legislature, and the executive. They are supposed to be independent organs of the state,’ emphasizing the crucial role of separation of powers in the legal system.

The challenge extends beyond the immediate dispute; the applicants are arguing that continuing criminal trials during the legal vacation disrupts the balance of power within the judicial system. Mr. Davies stressed that the applicants were not seeking to halt trials, but rather to challenge the decision to proceed during a period when the lawyers involved had indicated unavailability. He clarified that the applicants were advocating for the right to fair representation and the ability to choose their own lawyers, not to halt the trials altogether.

At the heart of the dispute lies a fundamental question: should trials during the legal vacation be permitted? The Supreme Court’s ruling is expected to determine whether the Chief Justice’s warrants are upheld, and whether the selected criminal cases will continue during the vacation.
