The legal proceedings concerning former National Signals Bureau Director Kwabena Adu-Boahene and his wife, Angela Adjei Boateng, have taken an unusual turn following a decision by lead counsel, Samuel Atta Akyea, to remain absent from the trial scheduled for Tuesday, August 11th, despite a directive from the court to continue the proceedings during a legal vacation. This decision, reportedly deliberate and rooted in the traditional purpose of the vacation, has ignited a significant debate within the legal community. Mr. Akyea, in a media interview with TV3, stated that the vacation period is primarily designed to provide lawyers with a respite from the demanding nature of court work, rather than to conduct substantive trials. He argued that the absence is an unusual departure from established practice and questioned why certain cases should receive special treatment. He described the arrangement as a departure from the conventional approach, stating, ‘So, we do not understand why, in the name of expedited trial and ambulance trials, some special courts should sit to deal with some special cases probably to achieve some special ends. We do not understand it.’

Mr. Akyea further emphasized the increasing utilization of virtual proceedings, suggesting that lawyers can participate in urgent hearings remotely without disrupting the broader purpose of the vacation. He asserted that the arrangement represents a significant shift from the established court practice, questioning why certain cases should be prioritized in this manner. The High Court in Accra has issued a six-day notice to Mr. Atta Akyea and his legal team to secure the presence of their lawyers for the continuation of the trial on August 17th. The court has explicitly warned that failure to appear with counsel will result in the witness being personally cross-examined.

This development follows a previous directive from the court, which stipulates that if the accused persons fail to conduct the cross-examination of the fourth prosecution witness, they will be required to personally continue the process. Justice Francis Apangabonu Achibonga, a Justice of the Court of Appeal sitting as an additional High Court judge, has directed that if the accused persons fail to conduct the cross-examination themselves, the witness will be discharged. The directive is a direct response to proceedings held on Tuesday, August 11th, when Mr. Adu-Boahene and his wife appeared in court without their legal team.

The charges against Mr. Adu-Boahene and his wife are significant, including allegations of stealing GH¢49.1 million intended for a cybersecurity defense system. They are pleading not guilty and are on bail.

This case represents a notable disruption to the trial schedule and has raised questions about the court’s procedures and the balance between expediting trials and adhering to established legal principles. The legal ramifications of this unusual situation are still unfolding, and the court’s guidance remains crucial to navigating this complex legal landscape. The circumstances surrounding the absence of key legal personnel are being closely scrutinized as the trial progresses.
