The Ghana Bar Association (GBA) has initiated a formal appeal to Chief Justice Paul Baffoe-Bonnie to safeguard the established legal vacation framework within Ghana, specifically addressing the practice of counsel’s unavailability during this crucial period. The GBA’s letter, addressed to the Chief Justice on Monday, August 10, highlights a longstanding tradition of Vacation Courts prioritizing urgent and interlocutory matters, and underscores the importance of judicial integrity.

In a letter to the Chief Justice, the GBA emphasizes that the legal vacation, spanning August 1st to September 30th, is intended to provide judges with a necessary respite from the demanding court calendar, allowing for crucial breaks and opportunities for reflection. However, the association acknowledges that Vacation Courts may, in certain circumstances, require the presence of counsel to address urgent and interlocutory matters.

The GBA’s position is clear: where counsel has formally notified the court of an inability to appear during the vacation, the matter should not proceed without the lawyer’s presence. The association asserts that counsel should not be compelled to attend Vacation Courts, regardless of the Court’s scheduled listing of the case. “Counsels are not under any compulsion whatsoever to appear before a Vacation Court,” the association stated, advocating for a system that respects judicial autonomy and allows for effective participation in proceedings.

The GBA’s intervention follows a series of complaints from three law firms alleging that the Chief Justice’s directives instructing lawyers to appear before judges to continue hearing part-heard criminal cases during the current vacation period undermine the purpose of the legal vacation. These directives, the GBA argues, erode the established judicial practice and diminish the opportunity for counsel to adequately prepare for and participate in court proceedings.

The GBA has urged the Chief Justice to take decisive action to ensure that judges rigorously adhere to the established rules and traditions governing the legal vacation. The association stresses that respect for this established practice is vital for preserving the integrity of the judicial system and facilitating effective administration of justice. The GBA envisions a system where judges are afforded ample opportunity to rest and where, when required to appear, they can effectively contribute to the court’s proceedings. The association’s call underscores the importance of maintaining a balanced judicial system that values both judicial independence and the efficient administration of justice.

Specifically, the GBA requests the Chief Justice to review and reaffirm the existing guidelines regarding vacation court proceedings, ensuring that judicial discretion is not unduly curtailed. The association further highlights the need for clear communication and a robust system of judicial oversight to safeguard the established legal vacation framework, safeguarding its purpose and promoting optimal judicial participation.

According to a recent report by the Ghana Legal News, the legal vacation is a longstanding tradition in Ghana, with the GBA having repeatedly emphasized the importance of upholding this practice. The GBA’s appeal is a significant step in preserving the integrity of the judicial system and ensuring that judges remain available to address matters within the legal framework.

Furthermore, the GBA points out that the current directives create a potential for confusion and uncertainty within the legal profession, potentially disrupting the smooth operation of the courts. The association emphasizes that maintaining a clear and consistent approach to vacation court proceedings is crucial for the continued stability and effectiveness of the legal system in Ghana.

The legal vacation is a cornerstone of the Ghanaian legal system, providing a crucial period for judicial reflection and allowing for the preparation of cases. The GBA’s call underscores the necessity of protecting this vital practice, ensuring judicial independence, and maintaining the integrity of the administration of justice in Ghana.
