President John Mahama has issued a direct appeal to the Supreme Court, demanding a fundamental shift in its communication style – a commitment to articulating its decisions with ‘extreme clarity.’ This unprecedented request underscores a deep-seated concern within the administration regarding public confidence in the judiciary, a concern that stems from a perceived lack of transparency and accountability within the legal system.

His address to the newly appointed Justices served as a pivotal moment, a clear articulation of a strategic imperative. President Mahama voiced a profound belief that the Court’s decisions, while crucial, must be meticulously documented and readily accessible. He stressed that this isn’t simply a matter of procedural compliance; it’s about fostering a relationship of trust between the judiciary and the citizenry, a cornerstone of a functioning democracy.

Furthermore, President Mahama highlighted the imperative for the judiciary to embrace innovation in its delivery of justice. He advocated for the ‘appropriate use of technology in the justice delivery system, regardless of citizens’ income, status or geographical location,’ suggesting a proactive approach to leveraging digital tools to improve accessibility. This initiative represents a significant step towards broadening the reach of justice and ensuring that legal services are available to all Ghanaians, irrespective of their circumstances. The administration is keen to ensure that the courts are not just competent but also accessible and understandable to everyone.

The request for increased clarity is driven by a growing sense that the judiciary, while vital, needs to be more readily understood by the public. It’s a recognition that the public’s understanding of legal processes is key to the legitimacy and effectiveness of the judicial system. According to a recent report by the National Judicial Council (NJC), the number of appeals to the Supreme Court has increased significantly in the past five years, raising concerns about the court’s ability to quickly resolve cases and address grievances. President Mahama’s call for enhanced clarity could be a critical component of a strategy to address this growing challenge, and it underscores the importance of maintaining public confidence in the judiciary as a cornerstone of the nation’s legal framework.
