The Accra High Court has decisively rejected a request by former Signals Bureau Director-General Kwabena Adu-Boahene to adjourn his trial pending a review application filed by Ofoase-Ayirebi MP Kojo Oppong Nkrumah concerning the continuation of selected criminal cases during the legal vacation period. The ruling, delivered on [Date of Ruling – Placeholder], effectively halts the proceedings, with the Supreme Court now expected to adjudicate a review application concerning the ongoing case. This pivotal decision follows a protracted battle between the prosecution and the defence, particularly concerning the pace of the trial itself. Counsel for Mr Adu-Boahene, Samuel Atta Akyea, formally requested the court to grant a temporary suspension of the trial, arguing that the outcome of the Supreme Court’s review would significantly impact the ongoing investigation and trial. He emphasized the importance of awaiting the Supreme Court’s determination of the substantive interlocutory application, which addresses the legal vacation status of the case. However, Deputy Attorney-General and Minister for Justice Justice Srem-Sai opposed the request, asserting that the prosecution had only one additional day to close its case. The judge, Justice Francis Apanga Achibonga, noted that the earlier Supreme Court decision remained binding until it was set aside or reversed, further reinforcing the court’s decision to dismiss the defence’s request for an adjournment. Mr Adu-Boahene is currently standing trial alongside his wife, Angela Adjei Boateng, Mildred Donkor, and Advantage Solutions Limited on 11 charges, including conspiracy, theft, and money laundering, all of which are punishable by imprisonment. The defence has maintained their innocence, pleading not guilty and currently maintaining bail. The dispute began with earlier disagreements between the defence and prosecution regarding the trial’s progress, culminating in a July 2025 High Court ruling rejecting a defence application seeking further disclosure of National Security operational account records dating back to 1992. Following this rejection, Mr. Atta Akyea sought to study the decision and consider further legal options, including an appeal or a stay of proceedings. The prosecution vehemently opposed this request, insisting that the trial should proceed without unnecessary delays, citing the need to protect due process and ensure the fair trial of Mr. Adu-Boahene’s client. At the time, Mr. Akyea accused the prosecution of withholding documents and stated: ‘I won’t accept any ambulance trial.’ He maintained that his approach is intended to protect due process and ensure that his client receives a fair trial, arguing that the justice system should not create an accelerated track for selected cases while other matters continue under the ordinary rules. The ruling represents a significant shift in the legal landscape, potentially impacting the trial’s timeline and the subsequent legal proceedings.”
