Chairman of the Hostel Owners Association, Bishop Dr Akwasi Owusu, has vehemently denounced the Rent Commissioner, Frederick Opoku’s, recent actions of inspecting private student hostels, alleging a blatant overstepping of his mandate. His accusations, detailed in a recent interview with Adom FM’s Dwaso Nsem, mark a significant escalation in a long-standing dispute between hostel owners and the Rent Commissioner, sparking considerable concern within the university community and raising questions about the balance of power within the regulatory framework governing student accommodation in Ghana.

According to Bishop Owusu, the existing regulatory bodies – the Ghana Tourism Authority, the Ghana National Fire Service, and the Police – already diligently oversee and regulate student accommodation facilities before they are granted licenses. These agencies conduct annual inspections, meticulously assessing standards to ensure compliance with legal requirements. ‘These agencies, including the Tourism Authority, Fire Service, Police, and others, come every year to inspect the facilities, checking everything to ensure it is in order before they license you,’ he stated, emphasizing the established, formalized process.

However, Bishop Owusu claims Opoku’s actions constitute a significant breach of the Rent Act and the Rent Commissioner’s existing legal authority. He accuses the Rent Commissioner of deliberately attempting to undermine the established regulatory structure, arguing that the definition of ‘premises’ under the law should not be solely reliant on the Rent Commissioner’s interpretation. ‘The law has a definition of premises, and it is clearly stated there,’ he asserted, further highlighting the concern that Opoku’s actions are a deliberate attempt to gain public favour through inspections without adequately considering the existing regulatory framework.’

His comments follow a petition from the National Union of Ghana Students (NUGS) detailing conditions at some private student accommodation facilities, prompting Opoku’s inspection. Bishop Owusu contends that the NUGS petition was initiated to determine whether the conditions on the ground genuinely warranted the inspection, suggesting a shift in focus from established regulations.

The controversy stems from a recent report detailing inspection conditions in some private student accommodation facilities as ‘appalling’ and ‘shocking’ following a petition from NUGS. The Rent Commissioner subsequently initiated a personal inspection, reportedly after receiving the petition, stating the concerns were reflecting the actual conditions. He emphasized that the law has a defined role, and he is questioning whether the Rent Commissioner is breaching these established rules.

Legal experts suggest this situation could have significant repercussions. The Ghana Tourism Authority, the Ghana National Fire Service, and the Police, are all responsible for ensuring the safety and security of student accommodation, and their presence in these inspections raises questions about jurisdiction. Furthermore, the legality of the Rent Commissioner’s actions – particularly concerning the definition of ‘premises’ – is currently under scrutiny, potentially impacting the overall stability of the student accommodation sector. The ongoing dispute underscores a broader challenge to the established regulatory balance within the university landscape, with students voicing concerns about high hostel fees and the potential for undue scrutiny.

Several students have also protested against the high hostel rental fees, petitioning the management to explore alternative solutions. The situation highlights a tension between the established regulatory framework and the practical realities of student accommodation, and it underscores the need for a robust and transparent regulatory system to protect the interests of both student hosts and students themselves. The NUGS petition, coupled with Bishop Owusu’s accusations, has amplified the discussion, pushing for greater accountability and oversight within the student accommodation sector in Ghana.
