Federal prosecutors will present a 2021 episode of the DJ Akademiks’ ‘Off the Record’ podcast as evidence in the trial concerning Lil Durk’s alleged murder-for-hire plot. The decision follows a request from the U.S. District Judge Michael W. Fitzgerald, who admitted the clip is being used to establish the government’s opening argument – that public pressure surrounding King Von’s death significantly affected Durk’s personal life. The clip, which includes a discussion of the lack of retaliation for Von’s death, is a key component of the prosecution’s strategy to connect Durk’s actions to the alleged motive. The Akademiks interview, featuring 6ix9ine and Wack 100, centers on their mocking of Durk’s perceived failure to retaliate after Von’s demise. Prosecutors argue that a witness is prepared to testify that Durk saw the discussion and was angered by the perception of inaction. Durk’s attorneys have challenged this premise, maintaining that they never saw the interview and that its relevance to the shooting that occurred roughly a year later is questionable. Fitzgerald nevertheless ruled that the 2021 episode, identified as Exhibit 170, can be presented to the jury. The prosecution also plans to introduce music videos, text messages, and photographs obtained from Durk’s iCloud account, as well as a 911 call from a witness to the August 2022 shooting, footage of Quando Rondo’s reaction after the attack, and the footage of when the members and associates of Only The Family reacted after the attack. Prosecutors have also included portions of an interview conducted with Durk, along with clips from Million Dollaz Worth of Game, and data from a 911 call from a witness. Furthermore, prosecutors have admitted that money connected to Durk and his associates paid for travel and accommodations associated with the alleged plot, including a credit card bearing Durk’s name that was used for a hotel room connected to the group. The indictment alleges that five men traveled from Chicago to California before the shooting and that a credit card bearing Durk’s name was used for a hotel room. Prosecutors have also cited a message attributed to Durk instructing an associate not to book flights under names associated with him. Durk and his co-defendants face a statutory maximum of life in federal prison if convicted in the murder-for-hire case.
