The New York City Council is currently embroiled in a contentious battle to ban the use of facial recognition technology at Madison Square Garden and other public spaces within the city limits, a move fueled by growing concerns over privacy and potential misuse of biometric data. The initiative, dubbed ‘Ban the Scan,’ represents a significant shift in the city’s approach to surveillance and data collection, particularly within a venue known for its extensive biometric tracking practices.

Madison Square Garden, a landmark for the New York Knicks, has long been criticized for its extensive data collection practices, with fans frequently being flagged on watch lists and their faces appearing in the Garden’s database. In January 2023, City Council member Shahana Hanif proposed a bill prohibiting public venues from deploying biometric recognition technologies, including facial recognition systems utilized by the Garden. This bill, initially met with resistance, now has 27 endorsements, representing more than half of the City Council, indicating a broad level of support for the legislation.

At a recent rally outside Madison Square Garden on Friday, musicians rallied in support of the ban, chanting “Ban the Scan!” The event was led by Paisley Fields, a Brooklyn-based country musician, and representatives from the Democratic-Socialist working group NYC DSA Tech Action, and digital rights advocacy group Fight for the Future. Hanif emphasized that the bill is rooted in concerns about surveillance and the potential for misuse of data collected through facial recognition. She stated, “As a Muslim who grew up in post-9/11 New York, surveillance isn’t new. However, many may not understand the extent of the surveillance that they’re exposed to simply by attending a Knicks game or a concert at Madison Square Garden or one of its associated venues.” The fact that MSG spokesperson, James Dolan, is the primary collector of this data is particularly alarming to Hanif.

The controversy extends beyond MSG, with reports revealing that the venue maintains a database containing risk scores for celebrities and VIPs, including race and sexual orientation. In July 2023, WIRED reported that MSG also utilizes a database assigning risk scores to around 400 celebrities and VIPs, including their faces. This data collection has led to a ban on numerous lawyers representing Dolan or Dolan-owned properties, including a mother who was blocked from taking her daughter to a Radio City Music Hall show.

Hanif’s bill now faces a significant hurdle, with the speaker’s office reportedly seeking to advance it with a discussion involving potential speaker Julie Menin. The debate highlights a growing tension between public safety concerns and the expanding use of technology in New York City, with many arguing that the city’s surveillance practices are excessive and pose a threat to civil liberties. The debate over the ‘Ban the Scan’ bill is a microcosm of a broader conversation about the balance between security and privacy in a rapidly evolving technological landscape.
