According to Amaliba, the Court of Appeal’s acquittal and discharge of Ms. Tamakloe-Attionu on July 30, 2026, definitively established that the prosecution had failed to meet the required standard of proof, as determined by the Supreme Court. This judgment, a pivotal moment in the case, was announced during a press conference where the DPP was tasked with reviewing the case.

The Court of Appeal, in a unanimous decision, held that Ms. Tamakloe-Attionu’s conviction and sentence of ten years were unlawful, citing a failure of the prosecution to present sufficient evidence to secure a conviction.

Mr. Amaliba’s comments highlight a crucial point: the Attorney-General’s decision to withdraw the stay of execution application was likely influenced by a review of the appellate court’s judgment.
