Tyrese Gibson secured judicial approval compelling his ex-wife to surrender as their parenting conflict entered a new, serious phase.
Tyrese Gibson scored a major courtroom development in Atlanta after a Fulton County magistrate judge authorized the arrest of his ex-wife Samantha Lee Gibson over allegations involving his custody rights.
Magistrate Judge Adam Petty granted Tyrese’s request following a hearing in Fulton County, according to Hip Hop Enquirer. The proceeding happened Wednesday (September 30).
Tyrese appeared in court personally while attorney Katherine Franklyn represented Samantha. After hearing arguments from both sides, Petty approved Tyrese’s request for an arrest warrant.
The legal clash centers on the former couple’s daughter, Soraya, and Tyrese’s allegations that Samantha interfered with his ability to exercise his parental rights.

According to court documents, Tyrese accused Samantha of taking their daughter out of state and failing to facilitate his visitation. The complaint stems from an alleged September 2025 incident in Atlanta.
Tyrese claimed Samantha’s actions were intentional and violated a parenting agreement the former spouses had reached the previous month.
Samantha has disputed his version of events. She opposed the warrant request and reportedly maintained that she has primary custody of Soraya. She also alleged that Tyrese’s application included inaccurate information concerning their custody battle and maintained that her relocation was known rather than concealed.
Judge Petty nevertheless ruled in Tyrese’s favor during Wednesday’s proceeding.
According to Hip Hop Enquirer, Samantha must surrender to the Fulton County Sheriff’s Office for booking. However, the judge has already authorized her release on a signature bond.
The arrest authorization does not amount to a finding that Samantha committed a crime and does not resolve the larger custody dispute between the former couple. The judge’s complete reasoning and the precise alleged offense underlying the warrant were not immediately available in the report.
Tyrese and Samantha married in 2017 and welcomed Soraya in 2018. They announced their separation in 2020 and have since battled through legal proceedings.
